This text focuses on the grounding of the legal and political structure of the modern state and starts from the Hobbesian conception of power as absolute and unlimited power. For their part, Spinoza and Bentham argue, against Hobbes, for the need to set certain limits to power, although they each based it on radically different grounds. Spinoza's political ontology makes it easy to carry out to the end what was permitted by a factual conception of power, which opens up the (...) possibility of thinking about power in a different way, namely, normatively. The difference between the utilitarian approach and that of Spinoza is his special conception of natural law, which leads him to maintain that it can only be defended where men have rights in common, that is, where there is civil order, making the preservation of our being the justification and limit of the institutionalization of the civil order. Bentham, however, remains true to his empiricist conception and a prisoner of its shortcomings, so that he cannot conceive of the limit of power except as self-limitation. The reason is that he does not have a sufficiently consistent concept of natural rights. Bentham's conception of them as “nonsense upon stilts” makes it impossible. (shrink)

Ante las dificultades que presenta el camino que hace ya algún tiempo se decidió emprender en este país, un camino lúgubre en el que proliferan como hongos diversas reivindicaciones del derecho de autodeterminación, esto es, de la soberanía, por parte de distintos pueblos o naciones, se hace evidente la necesidad de reflexionar sobre el mismo concepto del poder soberano. En este texto se aborda tal problema desde tres perspectivas, fáctica, normativa y racional. Al mismo tiempo que se ponen de manifiesto (...) las insuficiencias de las dos primeras, se defiende una comprensión racional del poder soberano, que quizá podría contribuir a la disolución de los malos augurios que se ciernen sobre nuestro futuro. Aunque se ha caracterizado el pensamiento liberal-democrático como la última ideología propia del fin de la historia, en este texto se considera que tal apreciación no es correcta pues ese pensamiento se apoya fundamentalmente en dos pilares, la democracia y la defensa de unos derechos humanos, que se encuentran en una tensión, que lejos de mostrar signos de agotamiento ideológico, constituye el núcleo teórico de la reflexión jurídico-política a lo largo del siglo veinte. La prueba más evidente de tal afirmación (...) la constituye el pensamiento de autores como Kelsen, Hart y Habermas, desde el que se ha intentado lograr la armonización entre el principio de la soberanía popular y el reconocimiento de una serie de límites al ejercicio del principio de las mayorías. This paper does resemble a philosophical-juridical perspective that reflects on the possibility to reconstruct the constitutional democracy through a Hegelian focus. Its aim is to tackle the current crisis of our liberal democracy, as well as to determine its causes. These causes are not only found in a deficient praxis of its purposes, but fundamentally in an insufficient understanding of the principles of that type of democracy. At the end, this democracy, if we mind to deter its ruin, has to (...) last on the idea of universal will and its determination through the individual rights and liberties. In this context, political liberties obtain a key role, especially the right of political participation and the freedom of expression, whose final purpose lays in the construction of a rational political will. No deja de llamar la atención que un autor considerado como subversivo y expulsado de su comunidad, sea después de todo el creador de los límites del estado político. Pareciera que debía haber sido el destructor de todo orden, cuando es precisamente el inspirador de un orden y además limitado. Su concepción del estado político no supone, como en Hobbes, el abandono del estado de naturaleza, sino la metamorfosis de este último en el primero, ya que aquello que se modifica, (...) el estado natural, permanece en lo modificado, el estado político. Reconoce que únicamente en la medida en que no es posible asegurar nuestra pervivencia en el estado natural por sí solo, es por lo que se requiere la institucionalización del estado político, aunque éste no puede construirse rompiendo con la razón de su creación que no es sino el aseguramiento de nuestra pervivencia física, el incremento de nuestra riqueza y la generación de las condiciones que hagan posible el cultivo de la razón. Las ideas de un autor como Spinoza fueron relevantes para resolver el problema de la fundamentación del Estado desde los inicios de la modernidad. Su presencia en la reflexión jurídico-política occidental impresiona, está desde el comienzo, con Hobbes, pero contra Hobbes, y además destacando la insuficiencia del núcleo central de la argumentación hobbesiana, en la medida en que la libertad de pensamiento exigirá para Spinoza la libertad de expresión. Desde entonces no dejará de acompañarnos, si bien de manera larvada, pues cada vez que se acercaron a justificar de una u otra manera el orden jurídico-político, la sombra de Spinoza puede entreverse. Spinoza pergeña el orden moderno, lo traza, aunque también es verdad que a partir de ese momento intentaron olvidarlo, en el sentido en que la mayor parte de los grandes autores, Kant y Hegel por ejemplo, si bien no frenaron sus propuestas, aunque a veces uno piensa que sí que lo hicieron, lo que es cierto es que no desarrollaron aquello que Spinoza dejó en ciernes. Reconocida la función creadora del juez y especialmente la del juez constitucional, que puede poner en cuestión mediante sus decisiones la capacidad normativa del propio poder legislativo, hasta el extremo de llegar a anular la ley adoptada por éste, se plantean dos cuestiones. La primera consiste en establecer los antecedentes de por qué el poder judicial es poder. En la segunda se aborda de manera específica el poder de la justicia constitucional con la finalidad de adentrarse en el problema central (...) de todo poder, el de su legitimidad enfrentada, en este último caso de manera evidente, a la legitimidad democrática del legislador. Mill tries to shape the government of social order according to the rules that served as a pattern for the constitution of the literary salons and clubs of the 17 th and 18th centuries. On these rules the Enlightened legal-rational model of society was built, whose demands as well as its differences from reality are enormous. However, this model, which remained in existence, although often broken, during the 19 th and 20 th (...) centuries, does not seem able to survive, even as a regulative ideal. The characteristics that now define the society of the masses in which we live make the fundamentals of Mill’s theory totally inadequate for an understanding of that society. (shrink)

It is evident that the international order has been changed at the beginning of the twenty-first century after the terrorist attacks of September 2001. Peace is the essential end of every constitutional democracy, internally -in the relationships that its members maintain among themselves-, as well as externally -those relations that a society sustains with others. The problem arises especially in the relation of constitutional democracies with other political regimes. Whereas Kant defended that the best means to achieve peace was the (...) expansion of the republican regime, Rawls’ defense of liberal democracy did not envisage its expansion. The relations of a constitutional democracy with other societies, whether democratic or not, necessarily require a limitation of sovereignty in their exercise abroad. However, the relations among different sovereigns remain underdeveloped, practically at the mercy of the good or bad will of each of them, without a praetor with the capacity to establish the universal will that should prevail in the relations among states. This text considers the results of the western powers’ recognition of Kososvo’s independence from three perspectives: firstly, the possible consequences (of which what is happening in Georgia already gives us some proof) of this independence proclaimed and recognised outside the provisions of international law, and which can be considered a precedent in other territories with similar problems; secondly, it proposes, following Hegel, a rational conception of the state, far removed from ideas of ethnicity based on race, language, and so on, (...) in which nationalism finds its inspiration. Finally, it analyses and criticises from the Hegelian perspective, as updated by the reasoning of authors such as Habermas, the foundations of nationalism, especially its mistaken defence of the pre-eminence of collective over individual rights. The concept of polarity is pervasive in natural language. It relates syntax, semantics and pragmatics narrowly, Semantics: an international handbook of natural language meaning, De Gruyter Mouton, Berlin, 2011; Israel in The grammar of polarity: pragmatics, sensitivity, and the logic of scales, Cambridge studies in linguistics, Cambridge University Press, Cambridge, 2014), it refers to items of many syntactic categories such as nouns, verbs and adverbs. Neutral polarity items appear in affirmative and negative sentences, negative polarity items cannot appear in affirmative (...) sentences, and positive polarity items cannot appear in negative sentences. A way of reasoning in Natural Language is through Natural Logic. This logic is based on the concept of polarity in order to make the meaning of a sentence weaker o stronger without changing its truth value. There exist many proposals to compute polarity in the Natural Logic context, the most widely known are the ones by: van Benthem, Sánchez-Valencia, Dowty, and van Eijck, 6th international Tbilisi symposium on logic, language, and computation, Batumi, Georgia, Springer, 2007). If Natural Logic is going to be used, as an inferential mechanism between text fragments, in Natural Language Processing applications such as text summarization, question answering, and information extraction, it is a priority to know what the existing relationship among the aforementioned algorithms is; for example, to implement the most general. We show in this paper the equivalence among the analyzed algorithms, filling a gap in Natural Logic research, particularly in computing polarity, and the soundness of their algorithms. (shrink)

En este trabajo analizamos las estrategias de comunicación virtual empleadas por el movimiento de justicia global en España, desde aquéllas que tienen como objetivo la sensibilización política o aumentar la visibilidad y/o la transparencia de la organización hasta las que están orientadas a favorecer la comunicación interactiva entre miembros y/o en el público en general, pasando por las que persiguen la participación en movilizaciones. Nuestra descripción se fundamenta en un análisis de las características indicativas de estos diversos usos comunicativos que (...) podemos encontrar en las páginas webs de una muestra de 37 organizaciones. La interpretación de los resultados de este análisis permiten valorar en qué medida las prácticas comunicativas asociadas al uso de las páginas webs, más allá de su potencial reducción en los costes de comunicación, aparecen asociadas a transformaciones en la naturaleza de su actividad organizativa y de presión política de este movimiento. Stakeholder Theory combines the pursuance of business goals and responsibility toward a firm’s stakeholders. Despite the wealth of research on Stakeholder Orientation, we still have much to learn about specific measurements for several related constructs. In this study, we draw on two samples of 129 and 151 Spanish firms, respectively, to investigate CEOs’ perceptions on Stakeholder Integration (SI), leading to the identification of three dimensions of the construct. In this respect, our study suggests that Knowledge of Stakeholders, Interactions between a (...) firm and its stakeholders, and the adaptation of a firm’s behavior to stakeholders’ demands constitute the main dimensions of SI. This construct has the potential to connect the stakeholder and strategy literatures. (shrink)

In today's world, the corporate image of the largest companies is closely linked to their performance in the field of corporate social responsibility and the disclosure of information on that topic, specifically, on climate change. Since the Board of Directors is the body responsible for this process, the aim of this article is to show the role that companies' Boards of Directors play in the accountability process vis-à-vis stakeholders in relation to one specific aspect which has enormous significance in environmental (...) information: practices used to monitor greenhouse gas emissions. In order to achieve this, we shall verify certain business characteristics, in addition to the size and activity of the Board of Directors, and we shall take different dependence models into consideration. These models will include variables related to the level of independence and diversity of the Board of Directors, which interact with dummy variables representing the company's litigation risks regarding environmental behavior and the institutional macro-context of the organization's country of origin. The results make it clear that Boards of Directors are basically focused on the traditional responsibility of creating economic value, instead of dealing with today's broader business world concepts, which include social responsibility. This focus, therefore, does not favor the accountability process before other stakeholders, if this makes it more difficult to protect the interests of shareholders. (shrink)

La filosofía cartesiana tuvo sus orígenes en el espíritu de la época del siglo XVII y en el entorno y contexto del Collège La Flèche, durante la escolaridad de René Descartes en las aulas de mencionado recinto. Dirigida por los sacerdotes de la Compañía de Jesús, esta institución impartía educación a la luz de la Ratio Studiorum. El pensador francés abandona las enseñanzas del claustro al desencantarse del sistema y del contenido de los conocimientos transmitidos por la mayoría de sus (...) maestros y se da a la tarea de buscar un método que le brindara los elementos suficientes para construir un sistema de pensamiento, el cual asimismo respondiera a las nociones e ideas que pretendía construir. El padre Denis Mesland y Descartes entablan una relación intelectual-epistolar y debaten las ideas filosóficas propuestas por el pensador. Mesland se ve obligado a viajar al Nuevo Continente a cumplir nuevas misiones impuestas por sus superiores. Este artículo tiene como finalidad ofrecer algunas luces que permitan dar respuesta, en alguna medida, a la pregunta: ¿Mesland, en realidad, enseñó filosofía cartesiana en el Colegio Máximo jesuita de la provincia de Santafé en el siglo XVII? По мнению Майнеза, каnитальные проблемы аксиологии могут быть сведены к четырем: а) проблема существования ценности; б) nроблема оценочного nознания; в) проблема реализации ценности; д) проблема свободы выбора личностью ценности. В данной работе анализируется в основном те идеи этого автора, которые касаются nервой из этих больших nроблем - вопроса о существовании ценностей. En opinión de Maynez los problemas capitales de la axiología son cuatro: a) el problema de la existencia del valor; b) el problema del conocimiento valorativo; c) el problema de la realización del valor; d) el problema de la libertad del hombre en la elección del valor. Los materiales que integran este libro provienen del II Encuentro de Egresados realizado en el verano de 2012 por la Maestría en Estética y Arte de la BUAP. Regresaban a su academia los que alguna vez fueron sus estudiantes. Venían con el propósito de reencontrarse con los avances investigativos de sus profesores y a traer ellos mismos los resultados de la continuidad de su trabajo de investigación. Algunos dejaron también en el encuentro una muestra de su arte. El ciclo de (...) conferencias impartido por profesores de la planta académica y por varios invitados encuentra su plasmación en la primera parte del libro intitulada “Desde la academia”. “De regreso a la academia”, la segunda parte, incluye trabajos que los egresados de la MEyA presentaron con sus avances investigativos posteriores a su egreso del programa. La tercera parte muestra el Catálogo de las obras que seis de los egresados-artistas presentaron en la exposición de artes plásticas “En las pupilas del que regresa”. (shrink)

A propósito de la publicación en Suhrkamp de los Philosophische Aufsätze de Tugendhat (1992), se propone una interpretación de la obra del autor (hasta ese momento) que no se conforma a la visión tópica de la ruptura entre el Tugendhat fenomenológico y el analítico-lingüístico, sino que subraya (o demuestra, más bien) los elementos de continuidad entre ambas fases, destacando el papel que cumple en ambos casos la lectura de Aristóteles y su estructura "ti kata tinos" (algo de algo), que es (...) a la vez lógica y ontológica. Un ejemplo significativo: la lectura heideggeriana de la teoría de la identificación de particulares de P. F. Strawson a partir de la inter-remisión de lugares espacio-temporales del mundo. (shrink)

Background: Serious games have shown positive results in increasing motivation, adherence to treatment and strengthening the therapeutic alliance in multiple psychiatric disorders. In particular, patients with impulse control disorders and other disorders in which the patient suffers from inhibitory control deficits have been shown to benefit from serious games.Aim: The aim of this study was to describe the characteristics and to evaluate the usability of a new serious videogame, e-Estesia. This serious videogame was designed to improve emotion regulation in patients (...) with gambling disorder. Preliminary results from a pilot sample are also reported.Method: A pilot sample of 26 patients undergoing treatment for GD was recruited. Participants used e-Estesia on a tablet, which was connected to a thoracic band that sent heart rate and heart rate variability data to the videogame platform in order to provide biofeedback. The System Usability Scale was completed by patients to determine the usability of e-Estesia.Results and Discussion: e-Estesia performed comparatively well for all the explored groups. Around 84.6% of the patients endorsed that it was easy to use. Female patients with GD presented higher HRV during the use of the serious videogame compared to men. (shrink)

The stakeholder theory has become influential in the field of business management, especially concerning environmental and social issues. Nevertheless, there is room for improvement in the way this theory is taught in higher education. In this work, an experiential teaching method is proposed where the firm is no longer the center of analysis, and business situations are approached from the perspective of participating stakeholders. An original role-playing activity with detailed instructions to be adapted and used by interested educators was put (...) into practice with the participation of Spanish undergraduate students. Results showed that this teaching method helped promote stakeholder thinking in management courses and led students to evaluate the power of different stakeholders. (shrink)

The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

The self- vs. external-regulation behavior theory, SR-ER Theory model has postulated the Self-Regulation /Non or De-Regulation/Dys-regulation continuum in the person and in their context. The model also generates a behavioral heuristic that allows us to predict and explain the variability of other dependent behavioral variables in a range of scenarios. Consequently, the objective of this study was to validate the different scales prepared on the basis of the theory presented. A total of 469 students voluntarily completed at different times the (...) five questionnaires presented, to give a total of 1,385 completed questionnaires. Using an ex post facto design, descriptive, correlational, confirmatory factorial analysis, reliability, and concurrent validity analyses were carried out. The scales were analyzed individually and as a whole. The results showed the acceptable structure of scale and consistent levels of reliability. The five levels generated by the SR-NR-DR combinatory heuristic that arises from the theoretical model determined significant differences in the levels of the variables analyzed for each psychological context. We discuss the theoretical implications and the implications for the assessment and improvement of the behaviors analyzed in function of the personal and contextual regulation levels evaluated. Background: In Hospital Emergency Department and Emergency Medical Services professionals experience situations in which they face difficulties or barriers to know patient’s advance directives and implement them. Objectives: To analyse the barriers, facilitators, and ethical conflicts perceived by health professionals derived from the management of advance directives in emergency services. Research design, participants, and context: This is a qualitative phenomenological study conducted with purposive sampling including a population of nursing and medical professionals linked to Hospital Emergency Department and Emergency Medical (...) Services. Three focus groups were formed, totalling 24 participants. We performed an inductive-type thematic discourse analysis. Ethical considerations: This study was approved by ethical committees of Ethical Commitee of Clínic Hospital (Barcelona) and Comittee of Emergency Medical Services (Barcelona). The participants received information about the purpose of the study. Patients’ anonymity and willingness to participate in the study were guaranteed. Findings: There were four types of barriers that hindered the proper management of patients’ advance directives in Hospital Emergency Department and Emergency Medical Services: personal and professional, family members, organisational and structural, and those derived from the health system. These barriers caused ethical conflicts and hindered professionals’ decision-making. Discussion: These results are in line with those of previous studies and indicate that factors such as gender, professional category, and years of experience, in addition to professionals’ beliefs and the opinions of colleagues and family members, can also influence the professionals’ final decisions. Conclusion: The different strategies described in this study can contribute to the development of health policies and action protocols to help reduce both the barriers that hinder the correct management and implementation of advance directives and the ethical conflicts generated. Este campo no pudo escapar al fenómeno de la sociedad del espectáculo que hoy envuelve a casi toda actividad humana. Ello indiscutiblemente afecta la manera en que se valora esta actividad actualmente, vista las más de las veces como un simple aditamento utilitario con más fines comerciales que artísticos. A pesar de ello no deja de ser loable una revaloración de la disciplina que la (...) considere como una producción también transutilitaria, un fenómeno a la vez estético y extraestético y una actividad que, a través de su propia praxis, construye al ser histórico... The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. The question of whether the entrepreneur is born or made, forces us to respond that the entrepreneurial culture clearly breaks with the myth that entrepreneurs are born. Currently, it is considered that entrepreneurial skills can be acquired like any other discipline and that is why it should be taught. Their teaching and learning are key to the well-being of the teacher and to the positive achievement of the students. The entrepreneurial culture is an educational objective of developed societies and has (...) its origin in the business culture. There are two current models, American and European. The one that develops in the Extremadura region, based on the European model, tries to create a vital state in the participating students that enhances competences such as creativity, personal initiative or self-confidence, elements that try to generate a true motivation to undertake. The motivated, accomplished and positive teacher contributes to that achievement and achieving it favors the well-being of teachers. It’s a round trip. It is a “do ut des.” In our research, we evaluated four entrepreneurial culture programs in the classroom: “Junioremprende,” “Teenemprende,” “Experemprende,” and “Youthemprende.” The teachers involved in the programs are 356, and the valid questionnaires are 154. The students enrolled in the programs are 4800, and the questionnaires valid 1198. In the questionnaire, one of the key questions is “general teacher satisfaction,” with 17 common questions for all the programs. An essential question posed is: “I am satisfied with the achievements obtained by my students to participate in the program” The results of our research, according to a seven-point Likert scale, gives a very high degree of teachers’ satisfaction. Their satisfaction was centered on the perception of their teachings are conducive to the achievement of his students. The degree of teacher satisfaction for each of the programs and significantly means differences were found with Junior program resulted the more satisfied for teachers. For students, participation in the programs resulted in high development of entrepreneurial competencies. Similarly to teachers results, Junior program was found more significant in developing students’ entrepreneurial competencies indicating that entrepreneurial education is very appropriate for children. Findings of this study suggest that entrepreneurial education should be encouraged for students at every stage of education. (shrink)

Antecedentes. En el 2007 se legalizó el aborto en la Ciudad de México, acusando una elevada mortalidad materna por aborto.Objetivo. Analizar los datos generales de la mortalidad materna y por aborto en el país y en la capital.Metodología. Estudio retrospectivo, con datos obtenidos del INEGI. Cálculo de la razón de mortalidad materna general y por aborto. Análisis de correlación de Pearson y regresión lineal de los resultados. Análisis de tendencias de incremento y decremento anual. Desglose de muertes maternas.Resultado. Regresión lineal (...) sobre la RMM nacional (R² = 0.87) con tendencia a la baja; RMM por aborto nacional (R² = 0.49) con débil tendencia hacia la baja; RMM por aborto en la Ciudad de México (R² = 0.001) no muestra una tendencia hacia la baja.Conclusión. La despenalización del aborto en la Ciudad de México no mostró tener un impacto en la reducción de muertes maternas por aborto. El aborto provocado ocupa el 12° lugar de las muertes maternas en México. (shrink)
